Purchasing Conditions

Introductory Note

WAY Cables welcomes customers worldwide who genuinely love music and seek a profound listening experience, enabling them to purchase directly. These conditions ensure full access to product support, service coverage, and delivery provisions. At WAY Cables, we are united with our users by a shared love for music and uncompromising sound quality.
Our mission is simple and heartfelt: Music ‘n’ Joy.

📘 UNDERSTANDING THE BASICS 

ARTICLE 1. Definitions

• WAY Cables: Refers to the specific legal entity issuing the invoice for the products, either WAY Cables based in Serbia, or WAY Cables based in Slovenia, EU.
• Customer:
  a) Consumer: Any individual acting for purposes outside their trade, business, craft, or profession.
  b) Commercial Customer: Any legal entity or professional buyer.
• Products: One or more WAY Cables products that WAY Cables sells and delivers.
• Writing: Any written communication, including physical documents, emails, and digital correspondence.
• Offer: Any written proposal in which WAY Cables commits to sell and deliver a specific quantity of products under specified conditions.
• Order: Any customer request to purchase and receive WAY Cables products.
• Agreement: Any agreement, including invoices, amendments, and annexes, between WAY Cables and the Customer for the purchase and delivery of Products.
• Delivery: The moment WAY Cables transfers control of products to the customer, which for Commercial Customers begins when handed to the carrier, and for Consumers when they acquire physical possession of the goods.

ARTICLE 2. Application of the Conditions

2.1 These conditions apply to all offers, orders, and agreements.

2.2 WAY Cables expressly excludes the application of any general terms or conditions of the customer.

ARTICLE 3. Establishment of the Agreement

3.1 An agreement is established only when WAY Cables confirms the order and issues an invoice in writing, which may include additional conditions.

ARTICLE 4. Effective Date

4.1 These conditions apply to all agreements concluded on or after the Effective Date. WAY Cables reserves the right to amend these conditions, with amendments taking effect upon publication on the waycables.com website.

ARTICLE 5. Language

5.1 These conditions are prepared in English. 

📘 ORDERING & PAYMENT

ARTICLE 6. Prices

6.1 Prices are in Euros (EUR) and do not include shipping, local duties, or taxes. Import clearance and taxes are the responsibility and expense of the customer. The final invoice reflects only the product price and shipping. Any additional courier brokerage fees or local storage charges incurred during customs clearance are beyond WAY Cables’ control.

6.2 Prices depend on various cost factors that may fluctuate beyond WAY Cables’ control. WAY Cables reserves the right to update prices at any time without notice, except for confirmed and paid orders.

6.3 Customers can view current WAY Cables retail prices, excluding shipping, local duties, and taxes, on the waycables.com website.

ARTICLE 7. Order

7.1 Upon inquiry, WAY Cables provides a non-binding offer if the customer’s request is feasible. The customer consents by providing billing/shipping details, and WAY Cables confirms by issuing an invoice for payment.

7.2 By paying the invoice, the Customer explicitly requests and consents that the delivery be performed via Priority/Express courier services, acknowledging that such premium services are non-refundable in the event of a return (Right of Withdrawal).

ARTICLE 8. Payment

8.1 Full advance payment is required within five (5) working days of the invoice date, unless otherwise agreed in writing.

8.2 Failure to pay within the timeframe allows WAY Cables to treat the order as declined.

ARTICLE 9. Confirmation and Acceptance

9.1 By placing an order, the customer confirms they have read, understood, and accepted these conditions in full.

📘 DELIVERY & PACKAGING

ARTICLE 10. Delivery

10.1 Delivery is conducted under DAP (Incoterms) – Delivery At Place. While WAY Cables organizes the transport for the Customer’s convenience, the shipping costs are the Customer’s responsibility and are clearly stated on the invoice. WAY Cables provides all necessary export documentation and logistics, but the Customer is solely responsible for all import procedures, duties, VAT, and any administrative fees or brokerage charges applied by the carrier or local customs authorities at the destination.

ARTICLE 11. Packing

11.1 WAY Cables reserves the right to choose and use packing materials, considering them as final sale, which are not eligible for return or refund. 

📘 RETURNS, REPAIRS & UPGRADES

ARTICLE 12. Return and Refund Policy

12.1 Commitment to Quality: Each product is handcrafted, tested, and video-documented before delivery. This documentation serves as definitive proof of the product’s condition and functionality at the time of dispatch. Customers must follow the Instructions for Use.

12.2 Right of Withdrawal (15-Day Return): All returns must be made within 15 days from the date of delivery.

12.3 Condition of Goods: All returned items must be undamaged and free of signs of use, except for minor traces that might occur on connector contact pins, due to normal use. Returned items must have all original tags and labels attached, be in the original packaging, and shipped in the same box they were received in.

12.4 Customized Products: Items customized to specific lengths, configurations, or personalized finishes requested by the Customer are exempt from the right of withdrawal and are non-refundable, final sale.

12.5 Return Procedure: Customers must email WAY Cables within 15 days of delivery to receive instructions and a shipping label. They are required to use the designated courier and include the original packaging and shipping box they received with the items. 

12.6 Refunds and Deductions: WAY Cables operates on the principle of complete fairness.
If the return results from an error on WAY Cables’ part (such as defective or incorrect items), the full amount paid will be refunded.
For a standard return (Right of Withdrawal), the net amount received will be refunded, minus the actual logistics costs. The following deductions will apply:

• Logistics Costs: The actual costs of the initial Priority shipping to the customer and the return shipping back to WAY Cables are non‑refundable. For total clarity, the customer will be informed of these specific shipping amounts in writing during the inquiry process and before any payment is made.
• Transaction Fees: Any non‑refundable bank or payment processor fees incurred during the initial transaction and the refund process will be deducted, ensuring that the refund reflects the exact net amount WAY Cables received.
• Duties & Taxes: If any non‑refundable import fees are incurred during the return of the product to WAY Cables, these costs will also be deducted from the final refund, with proof of that paid amount provided to the customer.
• Process: Refunds are issued via bank transfer in Euros (EUR) within seven (7) days after WAY Cables receives and inspects the returned products.

12.7 Exchange: If the customer receives a wrong, defective, or damaged product and contacts WAY Cables within 15 days of delivery, it will arrange an immediate replacement and include a special gift with the new shipment as a gesture of apology. This does not affect the statutory 2-year warranty rights.

ARTICLE 13. Warranty

13.1 Period: 24 months from delivery.

13.2 Exclusions: Damage from misuse, neglect, accidents, or failure to follow Instructions for Use.

13.3 Voidance: Warranty is void if unauthorized repairs or modifications are performed.

ARTICLE 14. Product Repair and Refresh Services

14.1 WAY Cables offers proprietary repair and refresh services. These services are not authorized for third parties. Each servicing is evaluated individually.

ARTICLE 15. Trade-in and Upgrade

15.1 WAY Cables offers trade-in options for current and discontinued models, assessed case-by-case based on condition and original state.

📘 RESPONSIBILITIES & LEGAL

ARTICLE 16. Limitations of Liability

16.1 Liability is excluded except in cases of intentional misconduct or gross negligence by WAY Cables.

16.2 Indirect, consequential, or delay-related damages are not assumed.

16.3 Products are for residential indoor use only. Misuse is at the customer’s risk.

16.4 These limitations shall not affect any mandatory customer rights under applicable laws.

ARTICLE 17. Force Majeure

17.1 Obligations are suspended during Force Majeure (natural disasters, material shortages, war, terrorism, strikes, etc.). If it lasts over 60 days, either party may terminate with a refund of advance payments.

ARTICLE 18. Termination

18.1 WAY Cables may terminate immediately for unauthorized resale, reputation damage, or failure to remedy breaches within seven (7) days.

ARTICLE 19. Intellectual Property

19.1 Customer acquires no rights to WAY Cables’ intellectual property, production methods, designs, or models. Unauthorized use is prohibited.

ARTICLE 20. Data Protection

20.1 Personal data is processed lawfully and transparently (GDPR compliant).

20.2 Data is used exclusively for contract fulfillment and support.

ARTICLE 21. Applicable Law and Jurisdiction

21.1 Amicable Settlement: WAY Cables and the Customer shall first attempt to resolve any dispute amicably and in good faith within fifteen (15) days.

21.2 B2C Transactions (Consumers): These Conditions are governed by the laws of the country where the WAY Cables entity providing the invoice is registered (Serbia or Slovenia). EU consumers retain protection under the mandatory laws of their country of residence and also may seek guidance via the official EU portal: consumer-redress.ec.europa.eu. WAY Cables (Slovenia) does not recognize any specific provider of out-of-court settlement as competent.

21.3 B2B Transactions (Legal Entities): All disputes are governed by Serbian law and shall be finally settled by arbitration in accordance with the Rules of the Permanent Arbitration at the Chamber of Commerce and Industry of Serbia (Belgrade, three arbitrators, English language).

ARTICLE 22. Severability

22.1 If any part is invalid, the rest remains in effect.

ARTICLE 23. Entire Agreement

23.1 These conditions and the invoice constitute the entire agreement between the parties.
